Terms of Service

Virgil Resume (the "Service") is operated by Virgil AI LLC ("Virgil," "we," "us," or "our"), a Florida limited liability company. The Service is available at resume.hirevirgil.com. By creating an account or using the Service, you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

The Service helps you search for job postings, generates versions of your resume tailored to specific job postings using artificial intelligence, and produces related application materials such as suggested answers to common application questions. Job listings are aggregated from third-party sources and are provided for convenience; we do not control, endorse, or guarantee any listing, employer, or hiring outcome.

You must be at least 16 years old to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. Notify us promptly if you believe your account has been compromised. One account per person; accounts are not transferable.

Generating a tailored resume consumes one credit. Each credit includes one AI rewrite of that resume; further changes can be made by hand at no cost. Credits are obtained through paid plans or promotional codes:

• Starter Pack: a one-time purchase that grants a fixed number of credits. Starter credits do not expire.
• Job Hunt Pro: a monthly subscription that grants a monthly credit allowance. The allowance resets to the plan amount on each successful renewal; unused subscription credits do not roll over past a renewal.
• Promotional codes: may grant free credits valid for a limited period stated at redemption. Promotional credits expire at the end of that period. Promo codes are limited to one redemption per account, have no cash value, and may be modified or withdrawn at any time.

Payments are processed by Stripe. We do not store your full card details. Prices are stated at checkout and may change with notice; changes apply at your next renewal. You can cancel a subscription at any time, effective at the end of the current billing period; you keep any remaining credits from amounts already paid. Some features that rely on paid third-party services (such as job search and screenshot reading) are subject to fair-use daily limits.

If something goes wrong (for example, a generation fails after a credit was charged), we restore the credit. For purchase refunds, contact us at the address in Section 14 within 14 days of purchase; refunds for unused credits are handled case by case and are otherwise at our discretion except where required by law.

Tailored resumes and application answers are generated by AI from the material you provide. AI output can contain errors, omissions, or statements that do not accurately reflect your experience. You are responsible for reviewing every document before you send it to an employer. You must not use the Service to create materials that misrepresent your qualifications, education, or work history. We make no guarantee that use of the Service will result in interviews, offers, or employment.

You retain all rights to the content you upload (your resume, profile details, and preferences) and to the tailored documents generated for you. You grant us a limited license to store and process your content solely to operate and improve the Service, including sending it to the AI and job-search providers described in our Privacy Policy. We do not sell your content and we do not use your resume to train AI models.

You agree not to:

• use the Service for any unlawful purpose, or to create fraudulent or deceptive application materials;
• upload content you do not have the right to use, including another person's resume without their permission;
• attempt to bypass credit metering, rate limits, or access controls;
• scrape, resell, or systematically extract data from the Service;
• reverse engineer the Service or use it to build a competing product;
• interfere with the operation or security of the Service.

We may suspend or terminate accounts that violate these Terms.

Job listings come from third-party providers and employer sites. Listings may be inaccurate, expired, or removed without notice. When you follow an apply link you leave the Service, and the destination site's terms and privacy practices apply. We are not a party to any application, interview, or employment relationship between you and an employer.

The Service, including its software, design, and branding, is owned by Virgil AI LLC and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding. We retain all rights not expressly granted.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE OR SUITABLE FOR ANY PARTICULAR APPLICATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRGIL AI LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES (INCLUDING EMPLOYMENT OPPORTUNITIES), OR LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction. Either party may seek relief in small claims court for qualifying disputes.

We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new effective date and, where appropriate, notify you in the app or by email. Continued use after changes take effect constitutes acceptance.
